TERMS AND CONDITIONS

Background:

These are the standard terms that apply to the provision and use of facilities and services by Members and other users of The Gymnastics Academy. These terms specifically apply when the Member or user is a “consumer” as defined by the Consumer Rights Act 2015.

Definitions and Interpretation:

  • Consumer:
    • Definition: A person defined as a “consumer” by the Consumer Rights Act 2015. In the context of these Terms and Conditions, it refers to an individual Member or user of the Gymnastics Academy using facilities or services for personal use.
  • Gym/We/Us/Our:
    • Definition: The Gymnastics Academy, including all employees and agents, with the same address as mentioned above.
  • Member/You/Your:
    • Definition: An individual who is a Consumer, and whose membership application has been accepted by Us. The term continues as long as the individual remains a Member according to these Terms and Conditions.
  • Membership:
    • Definition: Membership of The Gymnastics Academy.
  • Membership Fees:
    • Definition: The fees due for Membership.
  • Membership Plan:
    • Definition: The frequency of membership fee payment, either monthly or termly.
  • Month:
    • Definition: A Membership billing period (not necessarily a calendar month).
  • Term:
    • Definition: 12 calendar weeks
  • Regulations:
    • Definition: The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
  • Billing Date:
    • Definition: The date your balance falls due each month.
  • Downgrade:
    • Definition: Transfer to another class of lesser monetary value.
  • New Member:
    • Definition: A person who has never previously held membership with Us or any person who books a free trial 
  • Current Member:
    • Definition: A person who holds membership with Us and pays membership fees.
  • Referer:
    • Definition: A person who holds membership with Us and refers another family to us.
  • Referee:
    • Definition: A family who does not holds membership with Us until the referral by a
  • On file:
    • Definition: data that is created by You and provided to us via electronic means.
  • Opt Out/ Opting out:
    • Definition: The action of choosing to withdraw from the service.

Additional Notes:

2.1 Words indicating the singular number shall include the plural and vice versa.

2.2 Upon Our acceptance there will be a contract between You and Us on these Terms and Conditions.

2.3 Members must obey the Our Code of Conduct. Breaches of the Our codes of Conduct will result in disciplinary action in line with The Gymnastics Academy disciplinary procedure for Members.

2.4 Our Membership does not include governing body membership.

Referral Program terms & conditions

Eligibility: 

3.1 The referral program is open to all current members of The Gymnastics Academy.

3.2 The referer and referee cannot be siblings as defined by clause 8.2

Referral Process:

3.3. Members can refer new individuals or families to The Gymnastics Academy.

3.4 In order to obtain the reward, referrals must result in the new member Paying Monthly or Termly Membership fees.

Rewards:

3.5 Upon successful referral, both the referee (new member) and the referer (current member) will receive a £5 discount on their monthly membership fees for the lifetime of the referred member’s paid period.

3.6 The discount applies as long as both the referer and referee remain active paying members during the referred period.

Limitations:

3.7 There is no limit to the number of people a member can refer.

3.8 A £5 discount will be applied to the referer’s fees for each successfully referred individual who becomes a paying member.

3.9 The referral discounts will not be applied retrospectively such that the referee must make us aware of the referer at the point of booking.

Payment Adjustment:

3.10 The discount will be automatically applied to the next billing cycle following the successful commencement of the referred member’s Monthly or Termly package.

Get your space for FREE:

3.11: Each referred family earns you a £5 discount, meaning that with 8 successful referrals, you’ll receive a total discount of £40. This entitles one member of your family to attend a beginners class for free each month. As referred to in our “refer 8 families and get your lessons free” marketing.

Trial class terms & conditions

Eligibility:

4.1New members are eligible for one free trial class.

Trial Class Enrolment:

4.2 To obtain a trial class, A new member must set up a payment account with The Gymnastics Academy. 

Automatic Enrolment:

4.3 If the new members does not opt out of classes within 72 hours, the new member will be automatically enrolled in the lesson which they booked the trial in.

Billing Details:

Unless they have opted out, 72 hours after the trial class, new members will be charged as follows:

4.4.1 Beginners classes: £39.99 (first month’s membership) + £19.99 (annual insurance) + £4.99 (achievement record book) = £64.97

4.4.2 Intermediate or Mini Squad classes: £67.99 (first month’s membership) + £19.99 (annual insurance) + £4.99 (achievement record book) = £92.99

4.4.3 Advanced or Squad classes: £99.99 (first month’s membership) + £19.99 (annual insurance) + £4.99 (achievement record book) = £124.97

Opt-Out Procedure:

4.5 If members do not wish to continue after the trial, they must opt out in writing within 72 hours of the trial class by sending an email to hello@thegymnasticsacademy.co.uk, or We will charge you the sum set forth at clauses 5.1.1-5.1.3

4.6 By booking or participating in the trial, members agree to these terms and conditions. The Gymnastics Academy reserves the right to interpret and enforce these terms at its sole discretion.

4.7 Opting out is only available for automatic enrolments. For all other enrolment types you must provide a one-month paid notice period.

Access Discount Terms & Conditions

Application Process:

5.1 In order to be considered for the Academy’s Access Discount, individuals must complete the official application form provided by The Gymnastics Academy.

Discretionary Approval:

5.2 Acceptance of the Access Discount is at the sole discretion of The Gymnastics Academy. Submission of an application does not guarantee approval.

Term and reapplication:

5.3 If approved your discount will last 12 weeks. 

5.3.1 You must reapply every 12 weeks by completing out official application form. 

5.3.2 If you do not reapply or are not re-accepted your discount will lapse after 12 weeks and your contract will default to our CORE pricing. 

Eligibility Criteria:

5.4 Individuals may be eligible for the Access Discount if they meet one or more of the following criteria:

5.4.1 Low-income families with a total household income of less than £23,000.

5.4.2 Receipt of benefits, universal credit, housing benefit, Council tax reduction (excluding single person discount).

5.4.3 One or more parents out of work.

5.4.4 Asylum seekers.

5.4.5 Recently unemployed.

5.4.6 Working tax credit recipients.

5.4.7 Personal Independence Payment (PIP) recipients.

5.4.8 Disability Living Allowance (DLA) recipients.

5.4.9 Individuals on maternity leave.

5.4.10 Incapacity Benefit recipients.

Proof of Eligibility:

5.5 Applicants may be required to provide documentation as proof of eligibility, such as income statements, benefit letters, or other relevant documents.

Confidentiality:

5.6 All information provided during the application process will be treated with the utmost confidentiality and used solely for the purpose of determining eligibility for the Access Discount.

Approval Notification:

5.7 Applicants will be notified of the status of their application for the Access Discount within a reasonable timeframe.

Terms of Discount:

5.8 The Access Discount, if approved, will provide a 15% reduction on pay monthly fee’s. There shall be no reduction in Insurance fee’s or any other fee’s or costs associated with our products and services. 

Sibling Discount Terms and Conditions

Eligibility:

6.1 The 20% Sibling Discount is applicable to monthly and termly membership fees for siblings who are members of The Gymnastics Academy.

Relationship Requirement:

6.2 To qualify for the discount, all children must be biologically or legally related and living in the same household.

Discount Application:

6.3 There will be no discount on the first child

6.4 all children after the first child will receive the Sibling Discount 

6.5 The sibling discount shall be automatically applied to the monthly membership fees of eligible siblings once their membership status is confirmed.

6.6 The sibling discount will not be applied to the child on the most expensive membership plan, but will be applied to all other eligible siblings.

Verification:

6.7 The Gymnastics Academy reserves the right to request documentation or proof of sibling relationship and shared residence to verify eligibility for the Sibling Discount.

Duration of Discount:

6.8 The Sibling Discount will remain in effect as long as all qualifying siblings maintain active monthly memberships with The Gymnastics Academy.

Missing and Swapping classes Terms and Conditions

Eligibility:

7.1 Active members on a pay monthly or pay termly plan.

Priority Class:

7.2 Every enrolled member on a monthly or termly payment plan is guaranteed a reserved spot in their preferred weekly class, ensuring priority access for active participants.

Missing classes

7.3 If a member shall miss a class for ay reason you shall be entitled to a like-for-like class to make up for the missed lesson ,Subject to availability.

Temporarily Swapping classes 

7.4 If a member shall be unavailable for their preferred weekly class, they shall be entitled to temporarily swap this class to another like-for-like class, so as to ensure they do not miss the classes they have paid for.

Refunds

7.5 No refunds are given for missed classes.

Pay Monthly Membership Terms & Conditions

Commencement

8.1 Your membership will commence on the date of enrolment.

Duration of contract

8.2 Membership is a rolling contract with a one-month paid notice period from the billing date after you cancel.

8.3 Unless you notify us that you wish to cancel your membership, it will continue indefinitely on a month-by-month rolling basis.

Cancellation

8.4 You shall be entitled to cancel at any time.

8.5 You shall be liable to make payment for the full duration of your notice period, irrespective of your attendance.

8.6 The Gymnastics Academy only accepts cancellations in writing to hello@thegymnasticsacademy.co.uk.

8.7 Canceling your direct debit without emailing written cancellation will not be accepted as notification that you wish to cancel your classes.

8.8 Verbal cancellations to front-of-house staff, coaching staff members, or during phone calls will not be accepted.

8.9 Should sufficient notice not be given, the following month’s fees will still be payable.

Payment

8.10 Membership Fees are payable via direct debit on a monthly basis.

8.11 Members are required to maintain an active direct debit on file. We reserve the right to refuse if an active direct debit mandate is not on file.

8.12 In the event that an active direct debit is not on file for a period exceeding 28 days, our system will initiate a cancellation process. In such circumstances You will be invoiced for the one-month notice period as per our policy, following which your lessons will be discontinued.

The CORE pricing for lessons is as follows:

8.13.1  1 x beginners class per week costs £39.99 per month

8.13.2  1 x Intermediate or mini squad class per week costs £67.99 per month

8.13.3. 1 x Advanced or squad class per week costs £99.99 per month

8.14  The Gymnastics Academy offers discretionary access discounts for low-income families and sibling discounts, as outlined in paragraphs 7 and 8 of this document.

8.15 The cost of your membership will be between £39.99 and £149.99 per calendar month, taken via your payment method held on file, plus an additional £49.99 per annum debited from your payment method held on file on or around the 1st September.

8.16 In the event of any underpayment of Membership Fees, we reserve the right to refuse entry until your account balance is cleared.

8.17 In the event of any underpayment of Membership Fees, we reserve the right to debit the arrears from your payment account.

8.18 If you fail to pay any outstanding amount upon its due date, you must pay us a late payment charge of £12.00, increasing to £32 if the outstanding balance isn’t cleared within fourteen (14) calendar days.

8.19 If you charge back any payments, a charge of £20 will be added to your account.

8.20 Failure to pay any outstanding sums will incur further administration and enforcement fees, for which you will be liable.

8.21 If you wish to change your bank or the account used to pay, you must update the billing information via email to hello@thegymnasticsacademy.co.uk.

8.22 If your Membership Fees are not paid for more than one week, we may refer the matter to a third-party debt collection company or firm of solicitors to enforce the debt, and you will be liable for further administration, court, and legal advisor fees associated with the collection of the outstanding debt.

Insurance

8.23 On the 1st September each year, each paying member will be charged a £49.99 annual insurance fee.

8.24 If you cancel your membership in writing on, or after 1st September you shall remain liable for the payment denoted at clause 

8.25 If you cancel your membership in writing prior to 1st September but your membership concludes after the 1st of September you shall be charged the pro rata equivalent of the insurance fee for your period of membership.

8.26 If you cancel your membership part way through your membership year, you shall not be eligible for any refund of the insurance fee.

Pausing your membership

8.27 Every pay monthly member is entitled to pause their membership for 4 weeks per calendar year.

8.28 While your membership is paused, you will be charged 33% of your normal monthly fee to retain your place in your lessons.

8.29 A period of pause cannot be enacted after we receive notification of membership cancellation.

8.30 If you pause your membership then decide to cancel, the cancellation process will commence the day after the pause finishes.

8.31 You may pause your membership by emailing hello@thegymnasticsacademy.co.uk, providing details of the dates and circumstances

Closures & Lesson Cancellations

8.32 Our prices are calculated over 48 weeks.We, therefore, shall close for 4 weeks per annum. 

Permanent Lessons Changes

8.33 You may upgrade your Membership Plans at any time, and we will increase your Membership Fees accordingly.

8.34 an immediate payment of the difference between your current subscription and your new, more expensive subscription will be debited from your account, this payment will be pro rata discounted for the time remaining until your next billing date.

8.35 Your billing date will remain the same, and on your next billing date you will be charged the full amount for the new class.

8.36 If you wish to downgrade your Membership Plan, you will be subject to a one-month notice period.

Pay termly Membership Terms & Conditions

Commencement

9.1 Your membership will commence on the date of enrolment.

9.2 The duration of each term is 12 weeks

Duration of contract

Cancellation

9.5 You will automatically be billed for the next term if you do not write to us know you wish to discontinue at least one month before the end of your current term.

9.6 Cancelling your direct debit without emailing written cancellation will not be accepted as notification you wish to cancel your classes.

9.7 Verbal cancellation to the front of house staff, to caching staff member or during this phone call will not be accepted.

9.8 We only accept notification in writing to hello@thegymnasticsacademy.co.uk

9.9 Should sufficient notice not be given the following terms fees will still be payable

9.10 You shall be liable to make payment for the full duration of your membership, irrespective of your attendance.

9.16 The cost of your membership will be between £120 and £330 per term, taken via your payment method held on file, plus an additional £49.99 per annum debited from your payment method held on file on or around the 1st September.

Holiday Camps Terms and Conditions:

Payment:

10.1 Payment in full is required at the time of booking for holiday camps

10.2 Active Members obtain a 20% discount off the pricing of holiday camps and any holiday camp extras purchased. 

10.3 To obtain the discount members must be fee paying members at the time of booking and on the date of the booked activity. 

Late Collection Fee

10.4 A £10 charge will apply for late collection if the child is not picked up by 3:10 pm.

Non-Refundable

10.5 Holiday camps are non-refundable.

Transfer Option:

10.6 We may, at our sole discretion, offer a transfer to another date if notified at least 3 days prior to the non-attended camp date.

Birthday party Terms and Conditions:

Payment:

11.1 Payment in full is required at the time of booking for Birthday parties

11.2 Active Members obtain a 20% discount off the pricing of  birthday parties and any birthday party extras purchased,

11.3 To obtain the discount members must be fee paying members at the time of booking and on the date of the booked activity. 

Additional attendee Fee

11.4 A £10 per person charge will apply for all additional attendee’s above those included in the original booking 

Non-Refundable:

11.5 Birthday Parties are non-refundable.

Transfer Option:

11.6  We may, at our sole discretion, offer a transfer to another date if notified at least 2 weeks prior to the date of the booked activity. 

Single Lesson Terms & Conditions

Payment:

12.1 Payment in full is required at the time of booking for Single lessons

Non-Refundable:

12.2 Single lessons are non-refundable.

Transfer Option:

12.3 We may, at our sole discretion, offer a transfer to another date if notified at least 2 days prior to the date of the booked activity.

Account credit and make up tokens Terms & Conditions

13.1. Credits and tokens in your account cannot be transferred to another non-member

13.2 Credits and tokens cannot be exchanged for any monetary value, or used in lieu of notice period payments.

13.3 Credits, tokens & unused lessons will be held on account to be used upon re-enrolment of membership.

Guest Pass Terms and Conditions:

Entitlement:

14.1 Pay Monthly and Pay Termly members are entitled to one guest pass per month.

Usage:

14.2 The guest pass allows a non-member to access the facilities for a single visit. Additional terms and conditions may apply, and the pass is subject to availability

Changes to Terms and Conditions

15.1. We may, from time to time, change these Terms and Conditions without giving You notice, but We

will use Our reasonable endeavours to inform You as soon as is reasonably possible of any such

changes.

Jurisdiction

16.1 Any dispute, controversy, proceedings or claim between you and Us relating to these Terms and

Conditions, the Contract, or the relationship between you and Us (whether contractual or otherwise)

shall be subject to the jurisdiction of the Courts of England and Wales.
