Background:
These are the standard terms that apply to the provision and use of facilities and services by Members and other users of The Gymnastics Academy.
These terms specifically apply when the Member or user is a “consumer” as defined by the Consumer Rights Act 2015.
Definitions and Interpretation:
Consumer: Definition: A person defined as a “consumer” by the Consumer Rights Act 2015. In the context of these Terms and Conditions, it refers to an individual Member or user of the Gymnastics Academy using facilities or services for personal use.
Gym/We/Us/Our: Definition: The Gymnastics Academy, including all employees and agents, with the same address as mentioned above.
Member/You/Your: Definition: An individual who is a Consumer, and whose membership application has been accepted by Us. The term continues as long as the individual remains a Member according to these Terms and Conditions.
Membership: Definition: Membership of The Gymnastics Academy.
Membership Fees: Definition: The fees due on a monthly basis for Membership.
Month: Definition: A Membership billing period (not necessarily a calendar month).Term: Definition: 12 calendar weeksRegulations: Definition: The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
Billing Date: Definition: The date your balance falls due each month.
Downgrade: Definition: Transfer to another class of lesser monetary value.
New Member: Definition: A person who has never previously held membership with Us or any linked organisation.
Current Member: Definition: A person who holds membership with Us and pays membership fees.
Referrer: Definition: A person who holds membership with Us and refers another family to us.
Referee: Definition: A family who does not holds membership with Us until the referral by a Referrer.
Insurance period: Definition: The duration of time during which the insurance policy is active and provides coverage. This period begins on the date you make payment
Insurance Year: Definition: 365 days from the date you are billed for insurance
Trial Class: Definition: A single session of three or less hours in duration, which is booked in accordance with our trial class terms and conditions.
Chargeback: Definition: The reversal of a single payment transaction, typically initiated by the customer or their bank.
Successful Referral: Definition: A referral that results in a new member enrolling in the gymnastics academy and committing to weekly lessons under a formal contract.
Preferred Weekly Class: Definition: A class chosen by the member as their regular, recurring session to attend each week.
Additional Notes:
2.1 Words indicating the singular number shall include the plural and vice versa.
2.2 Upon Our acceptance there will be a contract between You and Us on these Terms and Conditions.
2.3 Members must obey the Our Code of Conduct. Breaches of the Our codes of Conduct will result in disciplinary action in line with The Gymnastics Academy disciplinary procedure for Members.
2.4 Our Membership does not include governing body membership.
Referral Program terms & conditions Eligibility:
3.1 The referral program is open to all current members of The Gymnastics Academy.
3.2 The referrer and referee cannot be siblings as defined by clause 6.2
Referral Process:
3.3. Members can refer new individuals or families to The Gymnastics Academy.
3.4 In order to obtain the reward, referrals must result in the new member Paying Monthly or Termly Membership fees.
Rewards:
3.5 Upon successful referral, both the referee (new member) and the referrer (current member) will receive a £5 discount on their monthly membership fees for the lifetime of the referred member’s paid period.
3.6 The discount applies as long as both the referrer and referee remain active paying members during the referred period.
Limitations:
3.7 There is no limit to the number of people a member can refer.
3.8 A £5 discount will be applied to the referrer’s fees for each successfully referred individual who becomes a paying member.
Payment Adjustment:
3.9 The discount will be automatically applied to the next billing cycle following the successful referrals initial payment
Trial Class Terms & Conditions
Eligibility:
4.1 New members are eligible for one free trial class.
Trial Class Enrollment:
4.2 To obtain a trial class, A new member must set up a payment account with The Gymnastics Academy.
4.3 If the new member does not opt out within 48 hours, the new member will be automatically enrolled in the lesson which they booked the trial in.
4.4 Unless the new member has opted out within 48 hours of the commencement of the trial class, they will be considered to have entered into a contract with The Gymnastics Academy under the terms outlined in sections 8.1 to 8.35 of this document. As a result, the member will immediately be charged the monthly membership fee, along with the annual insurance fee, as specified in our price list.
4.5 If new members do not wish to continue after the trial, they must opt out in writing within 48 hours of the commencement of the trial class by sending an email to [email protected], or We will charge them as outlined in clause 4.4.
4.6 By booking or participating in the trial, new members agree to these terms and conditions. The Gymnastics Academy reserves the right to interpret and enforce these terms at its sole discretion.
4.7 If you do not attend your trial class you will still be required to opt out, unless you wish to continue with paid classes.
Access Discount Terms & Conditions
Application Process:
5.1 In order to be considered for the Academy’s Access Discount, individuals must complete the official application form provided by The Gymnastics Academy.
Discretionary Approval:
5.2 Acceptance of the Access Discount is at the sole discretion of The Gymnastics Academy. Submission of an application does not guarantee approval.
Term and reapplication:
5.3 If approved your discount will last 12 weeks.
5.3.1 You must reapply every 12 weeks by completing out official application form.
5.3.2 If you do not reapply or are not re-accepted your discount will lapse after 12 weeks and your contract will default to the pricing outlined in our price list.
Eligibility Criteria:
5.4 Individuals may be eligible for the Access Discount if they meet one or more of the following criteria:
5.4.1 Low-income families with a total household income of less than £27,000 in regions other than London or £32,000 in London.
5.4.2 Receipt of benefits, universal credit, housing benefit, Council tax reduction (excluding single person discount).
5.4.3 One or more parents out of work.
5.4.4 Asylum seekers.
5.4.5 Recently unemployed.
5.4.6 Working tax credit recipients.
5.4.7 Personal Independence Payment (PIP) recipients.
5.4.8 Disability Living Allowance (DLA) recipients. 5.4.9 Individuals on maternity leave. 5.4.10 Incapacity Benefit recipients.
Proof of Eligibility:
5.5 Applicants may be required to provide documentation as proof of eligibility, such as income statements, benefit letters, or other relevant documents.
Confidentiality:
5.6 All information provided during the application process will be treated with the utmost confidentiality and used solely for the purpose of determining eligibility for the Access Discount.
Approval Notification:
5.7 Applicants will be notified of the status of their application for the Access Discount within a reasonable timeframe.
Terms of Discount:
5.8 The Access Discount, if approved, will provide a 15% reduction on pay monthly fee’s. There shall be no reduction in Insurance fee’s or any other fee’s or costs associated with our products and services.
Sibling Discount Terms & Conditions
Eligibility:
6.1 The 20% Sibling Discount is applicable to membership fees for siblings who are members of The Gymnastics Academy.
Relationship Requirement:
6.2 To qualify for the discount, all children must be biologically or legally related and living in the same household.
Discount Application:
6.3 There will be no discount on the first child
6.4 All eligible children after the first child will receive the sibling discount
6.5 The sibling discount shall be automatically applied to the membership fees of eligible siblings once their membership status is confirmed.
Verification:
6.4 The Gymnastics Academy reserves the right to request documentation or proof of sibling relationship and shared residence to verify eligibility for the Sibling Discount.
Duration of Discount:
6.5 The Sibling Discount will remain in effect as long as all qualifying siblings maintain active monthly memberships with The Gymnastics Academy.
Missing and Swapping classes Terms and Conditions
Active Members
7.1 Only active members enrolled in a class are eligible for the benefits outlined below.
Reserved Spot in Preferred Weekly Class
7.2 Active members are guaranteed a reserved spot in their preferred weekly class, ensuring priority access and consistency for enrolled participants.
Missed Classes
7.3 If a member is unable to attend a scheduled class for any reason, they are entitled to attend a like-for-like makeup class, subject to availability.
Temporary Class Swaps
7.4 Members who are unable to attend their preferred weekly class may temporarily swap to another like-for-like class. This ensures they can still participate in their sessions without forfeiting any paid classes.
Refund Policy
7.5 Refunds will not be provided for missed classes. However, we encourage members to take advantage of our makeup class and temporary swap options to maximize their membership benefits.
Class Membership Terms & Conditions
Commencement
8.1 Your membership begins on the date of enrollment.
Duration of Contract
8.2 Membership operates on a rolling monthly basis.
8.3 Unless you provide notice of cancellation as defined in clause 8.7, your membership will continue indefinitely.
Cancellation
8.4 You may cancel your membership at any time by the method defined in clause 8.7.
8.5 Your contract has a one-month notice period, starting from the billing date following your cancellation request.
8.6 In compliance with clause 8.5 the minimum term of a contract is 2 months.
8.7 To terminate your contract you must submit a cancellation request in writing to [email protected].
8.8 You are responsible for payment throughout the entire membership duration, including the notice period, regardless of your attendance.
8.9 Cancelling your payments or discontinuing attendance without submitting a written cancellation in accordance with Clause 8.7 will not be considered a valid termination of your contract. In such cases, membership will remain active, and billing will continue.
8.10 Verbal cancellations, whether given to front-of-house staff, coaching staff, or over the phone, are not accepted.
8.11 If sufficient notice is not provided, the following month’s fees will still be payable, irrespective of attendance.
Payment
8.11 Membership fees are payable monthly.
8.12 The membership fees for each location are outlined in our price list, which forms part of this contract.
8.13 Membership payments will be taken via your registered payment method on a monthly basis. An additional annual insurance payment outlined in the price list will be debited on the enrolment date and every 365 days thereafter
8.14 In the event of payment arrears, we reserve the right to refuse entry until your account is settled.
8.15 We reserve the right to debit any outstanding arrears from your any and all registered payment methods.
8.16 Late payments will incur a charge of £12.00, increasing to £32 if not settled within 14 calendar days.
8.17 Chargebacks will result in a fee of £50 per charge back being added to your account.
8.18 Failure to pay outstanding amounts will result in further administration and enforcement fees, for which you will be liable.
8.19 Interest will be applied to all overdue payments from the date they become due until the date full payment is received. The applicable interest rate is 15% per annum.
8.20 To change your bank or payment account, you must update your billing information via our app or parents portal.
8.21 If payments are overdue by more than one week, we may refer the matter to a third-party debt collection agency or solicitor. You will be responsible for any additional administration, court, or legal fees.
Insurance
8.21 Upon enrolment and every 365th day thereafter, each member will be charged an annual insurance fee of the amount outlined in the price list.
8.22 Each members insurance will remain valid for 365 days.
8.23 If you cancel your membership in writing before the date insurance falls due, but your membership concludes after the expiration of your insurance you will be charged the insurance fee.
8.24 No refund will be provided for the insurance fee if membership is canceled partway through the insurance year.
8.25 Insurance is non-transferable and is exclusively valid for activities conducted at The Gymnastics Academy venues.
Pausing Your Membership
8.25 Members are entitled to pause their membership for up to 4 weeks per calendar year.
8.26 During a membership pause, you will be charged 50% of your usual monthly fee to retain your place in lessons.
8.27 A membership pause cannot be initiated after submitting a cancellation request.
8.28 If you decide to cancel after pausing your membership, the cancellation process will begin the day after the pause ends.
8.29 To pause your membership, email [email protected] with the dates and circumstances.
Closures & Lesson Cancellations
8.30 Our pricing is based on an annual operating schedule of 48 weeks, with the facility closing for a total of 4 weeks each year. There will be no refunds or reimbursements for closures totaling less than 4 weeks per annum.
Permanent Lesson Changes
8.31 You may upgrade your Membership Fees at any time, with corresponding adjustments to your payment amount.
8.33 An immediate payment reflecting the difference between your current fees and the new fee will be debited from your account. This payment will be prorated based on the time remaining until your next billing date.
8.34 Your billing date will remain unchanged, and you will be charged the full amount for the new class on your next billing date.
8.35 Downgrades to your Membership Fees are subject to a one-month notice period.
Non-usage of services
8.35 You shall not be entitled to any refund or extension of membership period for any lessons, services or activities paid for but not attended or used
Holiday Camp Terms & Conditions
Payment:
9.1 Payment in full is required at the time of booking for holiday camps
9.2 Active Members and their siblings obtain a 20% discount off the pricing of holiday camps and any holiday camp extras purchased.
9.3 To obtain the discount members must be fee paying members at the time of booking and on the date of the booked activity.
Late Collection Fee
9.4 The Late collection fee as defined by the price list will apply for late collection if the child is not picked up within 10 minutes of the end of their activity.
Non-Refundable
9.5 Holiday camps are non-refundable.
Transfer Option:
9.6 We may, at our sole discretion, offer a transfer to another date if notified at least 3 days prior to the non- attended camp date.
Birthday Party Terms & Conditions
Payment:
10.1 Payment in full is required at the time of booking for Birthday parties
10.2 Active Members and their siblings obtain a 20% discount off the pricing of holiday camps and any holiday camp extras purchased.
10.3 To obtain the discount members must be fee paying members at the time of booking and on the date of the booked activity.
Additional attendee Fee:
10.4 An additional fee per person charge will apply for all additional attendee’s above those included in the original booking
Non-Refundable:
10.5 Birthday Parties are non-refundable.
Transfer Option:
10.6 We may, at our sole discretion, offer a transfer to another date if notified at least 2 weeks prior to the date of the booked activity.
Single Lesson Terms & Conditions
Payment:
11.1 We only offer single lessons for parent and toddler classes.
11.2 Payment in full is required at the time of booking for Single lessons
Non-Refundable:
11.3 Single lessons are non-refundable.
Transfer Option:
11.4 We may, at our sole discretion, offer a transfer to another date if notified at least 2 weeks prior to the date of the booked activity.
Account credit and make up tokens Terms & Conditions
12.1. Credits and tokens in your account cannot be transferred to another non-member
12.2 Credits and tokens cannot be exchanged for any monetary value, or used in lieu of notice period payments.
12.3 Credits, tokens & unused lessons will be held on account to be used upon re-enrolment of membership.
Jurisdiction
13.1 Any dispute, controversy, proceedings or claim between you and Us relating to these Terms and Conditions, the Contract, or the relationship between you and Us (whether contractual or otherwise) shall be subject to the jurisdiction of the Courts of England and Wales.
Changes to Terms and Conditions
14.1. We may, from time to time, change these Terms and Conditions without giving You notice, but We will use Our reasonable endeavours to inform You as soon as is reasonably possible of any such changes.
